Tuguegarao councilor says former mayor Delfin Ting behind Sandiganbayan case

TUGUEGARAO CITY, Philippines- Tuguegarao City councilor Danny Baccay said he believes that the criminal charges filed against him at the Sandiganbayan was “political.”

In an interview with Forum, Baccay said the charges was filed in 2013 by a certain Romie Decena when he forged an alliance with now Mayor Jefferson Soriano, cutting his ties with former Mayor Delfin Ting.

Baccay said complainant Decena was a former staff of Ting and his son, Michael.

“Political sabi ko dahil ito ay hindi finile ngayon. I was accused before the 2013 elections…Because [in] 2013, I supported then Atty. Jefferson Soriano, so humiwalay ako kay Mayor Delfin Ting. So the one way of getting back at me, kumuha sila ng issues against me,” Baccay said.

He said right after he split ties with the Tings, there are about 4 to 5 cases filed against him at the Ombudsman. This current case at the Sandiganbayan, Baccay said, was the only one that prospered.

The Ombudsman has filed a case before the anti-graft court against Baccay for violation of Article 218 of the Revised Penal Code.

In its complaint, the state prosecutors said Baccay authorized the amount for the “codification of city’s ordinances.”

The Ombudsman said Baccay has the control and custody of the said amount, “which he is required by law to render an account within the prescribed period as provided under Commission on Audit Circular No. 97-002, dated February 10, 1997, in relation to Section 340, Republic Act 7160, the Local Government Code…”

For failing to render the amount within the prescribed period of the law, the Ombudsman found probable cause to indict Baccay.

But Baccay said he did not receive any money from the cash advance made by his secretary, Cris Samonte.

“Unliquidated cash advance ito ng former acting secretary ko, I was not the one who got the cash advance. I only authorize Mr. Cris Samonte as the head of the technical working group to make a cash advance for the codification projects,” Baccay said.

He said Samonte failed to finish the project when 3rd District Congressman Randy Ting requested to get Samonte as his chief of staff at the Congress and the money was since fully returned by Samonte to the Treasurer’s office.

Baccay also claimed Samonte was only included in the charges due to a “miscommunication” between the older Ting and Congressman Ting.

He, however, clarified that he believes only former Mayor Ting was behind the case and not Congressman Ting.

“I am not accusing Congressman Ting. I was saying na pinolitika ito ni former Mayor Delfin Ting to get back at me,” he said. -Northernforum.net
