TUGUEGARAO CITY, Philippines- Senator Leila de Lima on Monday, November 7, filed a “test case” against President Rodrigo Duterte, Rappler reported.
De Lima, in her petition, asked the Supreme Court to issue a writ of habeas data against Duterte, who, she said, is abusing his presidential immunity from suit.
De Lima was accompanied by her supporters and several women leaders on Monday in filing the 26-page complaint against Duterte.
In an earlier statement, De Lima said she believes that Duterte had abused his immunity from suit in invoking “lies” against her.
“I’m going to file a test case na may pagkakataon po na ‘di puwedeng ma-invoke ang presidential immunity from suit. This will be a test case. Kasama sa writ of amparo, habeas data,” De Lima said.
The senator also believes that the framers of the doctrine did not intend to say that any president could abuse the presidential immunity. TNF
